As the jury deliberated, however, the plaintiffs’ and defendants’ lawyers met and agreed upon a settlement, the details of which were not publicized.
The talcum-powder company also sat as defendant in a Los Angeles trial where a 36-year-old woman had filed suit for her mesothelioma, which she claimed developed after a lifetime of using Johnson’s Baby Powder. Johnson & Johnson agreed to a confidential settlement in this case, too.
The company surprised the legal community with these rapid-fire settlements, but still maintains that its talcum products do not contain asbestos.
JURY VERDICTS AND AWARDS AGAINST TALCUM POWDER COMPANIES FOR MESOTHELIOMA
As of March 27, 2019, Johnson & Johnson is named as defendant in more than 13,000 lawsuits in which plaintiffs blame the company’s talc-based products for the plaintiffs developing ovarian cancer and mesothelioma.
Two-dozen-plus lawsuits were scheduled for 2019, all of which center on allegations that Johnson & Johnson’s talcum powder caused plaintiffs’ mesothelioma. Because diagnosis of this illness is usually soon followed by the patient’s death, these cases are scheduled sooner than others. Of these cases a handful have already been to trial and were decided in favor of the plaintiffs.

In 2018, a jury awarded the plaintiff $27.5 million in compensatory and punitive damages after she was diagnosed with pleural mesothelioma from using Johnson & Johnson’ baby talc on herself and her children.
In 2019, a Manhattan plaintiff who was diagnosed with mesothelioma after using Johnson’s Baby Powder regularly over the course of her life was awarded over $300 million in compensatory and punitive damages.
Also in 2019, a California jury delivered a verdict for the plaintiff, a woman who was diagnosed with mesothelioma after a lifetime of use of Johnson’s baby powder. The woman had used it since she was a baby and into adulthood. Adult applications were for a makeup foundation and as a “dry shower.” The jury awarded the plaintiff $29 million.

The first talcum powder—and asbestos—connected ovarian cancer verdict in the U.S. occurred in 2018 in St. Louis. In this mass tort claim, 22 ovarian cancer patients were awarded $4.7 billion in damages for their illness after the talcum products they had used regularly tested positive for asbestos, and the company failed to warn consumers. All plaintiffs claim to have used Johnson’s Baby Powder and Shower to Shower to dust their genital areas.
