This was the 1st time I've used Zanes Law. It was a fantastic experience for having to go through a situation most would rather not. The attorney and staff were always available to answer my questions and explained things clearly and were obviously 100% in my corner. My attorney, Jim, was very genuine and made me immediately comfortable when I came in to speak with him about my case. Every case manager I dealt with was patient and helpful. I would definitely return to Zanes should the time ever come again that I need a personal injury firm.

car accident

Zanes Law was a terrific legal experience. I first went to a law firm that only wanted me to go to physical therapy and pad the bill, so they could utilize my insurance policy to its capacity. Once I went to Zanes, they were honest, professional and prompt with calls almost once a week. Sometimes I got a call just because we did not have contact for close to two weeks. Some calls were to just ask how I was doing. I also received more money than originally discussed. Great job Zanes Law!!!!! If need be I will use their services again. THANKS

A Recent Wrongful Death Case in Arizona

Personal injury attorneys who specialize in wrongful death are always needed in cases involving the death of a loved one. One of the most unfortunate cases in recent years illustrates this.

As a result of the Jeep rear-ending a mother’s car on a Phoenix freeway, the family can sue the manufacturer of the SUV for wrongful death since it did not install automatic emergency braking devices, which were available as optional equipment.

According to the court, the NHTSA’s decision not to require the devices preempted the state lawsuit, as argued by lawyers for Jeep’s parent company, Fiat Chrysler Automobiles.

How the Wrongful Death Accident Happened

Vivian Varela, aged 4, was riding in the back seat of her mother’s Lexus sedan when the crash occurred on Aug. 15, 2015. An emergency vehicle was blocking the off-ramp from the Loop 101 freeway in north Phoenix when Melissa Varela was preparing to take an exit.

After finishing her shift at a nearby hospital, a nurse was also planning to take the exit but didn’t notice stopped traffic until it was too late. The Jeep Grand Cherokee she was driving slammed into the back of the Lexus, killing Vivian and injuring her mother.

How the Wrongful Death Could Have Been Prevented

Although airbags and other safety features have been adopted by automakers to protect occupants, automakers have been incredibly slow to adopt crash-prevention technology. It was a $100 repair common in the auto industry.

Despite an automatic emergency braking (AEB) system being a promising new technology, it cannot prevent all accidents, according to the company. Based on expert modeling, Vivian would not have died if Chrysler’s version of emergency braking had been installed on the Jeep.

The case is one of several across the country that are challenging automakers over their responsibility for safety features such as AEB systems. Several states have passed laws requiring the devices to be installed in all new cars sold by 2025.

Why It’s Important to Hire a Scottsdale Wrongful Death Attorney Early On

Wrongful death cases are complex and can be difficult to prove. Even in the best circumstances, it can take years for a wrongful death case to go through court. This is why it’s so important to hire a wrongful death attorney in Scottsdale as soon as possible after your loved one has passed away.

We understand how to get results for our clients. The more time that passes between their death and filing a claim, the harder it will be to prove their injuries were caused by someone else’s negligence.

Wrongful Death Claims Are Complex

A wrongful death case is generally very complex and requires experts in many different fields of law to investigate and defend it properly.

This includes medical malpractice experts, biomechanical experts, and accident reconstructionists, among others. Without these experts, there is no way to prove that your loved one did not die from natural causes or some other cause unrelated to the defendant’s conduct.

You need someone who knows what they are doing and has experience with Arizona wrongful death cases. A good wrongful death attorney will know how to navigate the legal system and work with insurance companies to get you the compensation you deserve for your loss.

They Know How the System Works

While this may seem like something that would be common knowledge, the truth is that not everyone knows how the system works when dealing with these kinds of situations.

An attorney has experience dealing with wrongful death cases and knows what needs to be done for them to have a chance at winning their case. This gives them an advantage over other people who don’t know what they are doing when filing claims and working on cases like this

They Can Help You Preserve Evidence

The sooner you start working with an attorney, the more likely it is that they will be able to help preserve important evidence and documents related to your case. Evidence may include:

  • Photographs of the scene from both before and after the incident occurred
  • Any reports from emergency personnel
  • Witness statements
  • Any medical records

If you have not yet hired a lawyer, contact us today to discuss your case. You may be eligible for compensation from the responsible party.

Let a Wrongful Death Lawyer Take Some of the Pressure Off You

Hiring an attorney will allow you to take care of all other matters while dealing with this difficult time in your life. This includes making arrangements for burial or cremation (depending on your wishes).

You don’t want to be worrying about how this needs to happen while also trying to deal with other issues related to losing someone close to you. Your attorney will take care of all these matters so that you can focus on grieving the loss of your loved one.

If you are having trouble getting in touch with the driver who hit your loved one, contact us today. Our lawyers will work diligently to find this person and get them to come forward so that we can begin the process of resolving your case.

Why You Should Choose Our Wrongful Death Lawyers in Scottsdale, AZ

Our Scottsdale wrongful death lawyers believe that in the wake of losing a loved one, you should be focused on the healing process and being there for your family, not on dealing with legal minutiae. Losing a loved one is stressful enough on its own. We want to take as much of that stress as possible off your shoulders instead of adding to it.

That is why we do everything possible to make the process easy for you. At Zanes Law, we cover everything from A to Z so that you can focus on your recovery. We will even travel to your home, your office, the funeral home, or anywhere else that works best for you to conduct a free, no-obligation case evaluation.

We can even conduct the consultation over the phone. And you can sign up with us in one call, after which we will get the right to work gathering evidence and building a compelling claim.

Talk to a Wrongful Death Lawyer in Scottsdale, AZ

There are many reasons why it’s important to hire a Scottsdale wrongful death attorney early on when you have a family member who has died. The most important reason is that in cases of wrongful death, there can be a lot of damages that need to be paid.

Damages such as medical expenses in wrongful death cases are not covered by an insurance policy. So, an injured party (or their heirs) can sue for these claims in court.

If you want to ensure any kind of fair compensation for your loved one, or if you just need help navigating the legal system, it’s time to contact Zanes Law.
